After many years of minimal fines (620 USD max) for long overstays, Thailand is clamping down on those who overstay their Thai visa. Once these new proposals are passed by the current law makers (we expect this to happen within the next few months) persons guilty will be prevented from entering Thailand for a period of time (blacklisted).

The current proposal is for the length of time on the blacklist be related to the duration of the overstay and how the person was apprehended. If the person surrendered themselves the penalties are reduced. The newly proposed tiered blacklist durations are shown in the table below:

If the person surrenders themselves:

Overstayed Time Proposed Ban
<90 days No Blacklist
90-365 days 1 year
1-3 years 3 years
3-5 years 5 years
5 years + 10 years

If the person is apprehended:

Overstayed Time Proposed Ban
Up to 1 year 5 years
1 year + 10 years

AAA Legal Services strongly recommends any expatriates who are currently overstaying in Thailand leave the country as soon as possible and pay the current penalty which is 20,000 THB (about 620 USD). We can help you acquire the correct visa for your stay in Thailand on your return.
